By accessing or using the Jaykay Medical Staffing website, candidate portal, or any of our staffing services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Services.
Jaykay Medical Staffing provides healthcare staffing solutions, including but not limited to temporary, per diem, travel, and permanent placement of healthcare professionals at client facilities. Our Services include the public job board, candidate portal, application processing, credentialing, and placement management.
To use our Services, you must be at least 18 years of age and legally authorized to work in the United States. By creating an account or applying for a position, you represent that you meet these requirements and that all information you provide is accurate and complete.

All content on our website, including text, graphics, logos, images, software, and design elements, is the property of Jaykay Medical Staffing or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

As a condition of placement, candidates may be required to undergo background checks, drug screening, health screenings, and credential verification. By applying for positions through our Services, you consent to these checks as required by applicable law and client facility requirements. Adverse findings may affect your eligibility for placement.
Healthcare professionals placed through Jaykay Medical Staffing are employees of Jaykay Medical Staffing during their assignments, unless otherwise specified in writing. The client facility is not the employer of record for temporary and contract staff. Nothing in these Terms creates an employment relationship between the candidate and the client facility.
Compensation rates, pay schedules, and benefits (if applicable) are determined by the specific assignment and will be communicated prior to placement. Jaykay Medical Staffing is responsible for payroll, applicable taxes, and workers' compensation insurance for its employees on assignment.
To the maximum extent permitted by law, Jaykay Medical Staffing and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of revenue, employment opportunities, data, or other intangible losses.
Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount paid by you, if any, to Jaykay Medical Staffing in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Jaykay Medical Staffing, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your use of our Services, or your breach of any representation or warranty.
Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or secure.
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause or notice. You may discontinue your use of our Services at any time. Upon termination, provisions of these Terms that by their nature should survive will remain in effect.
These Terms are governed by and construed in accordance with the laws of the State in which Jaykay Medical Staffing maintains its principal office, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise agreed in writing.
We reserve the right to modify these Terms at any time. Material changes will be posted on our website with an updated “Last updated” date. Your continued use of our Services after modifications are posted constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
